I have also come across this problem and well for now they fail till I read this according to the iet you omit the earth test and simply note it down on the paperwork
It isn't Double Insulated. It has an earth wire on the supply cable earthling the metal frame. If it were Double Insulated it would have, besides the mark, a twin core supply cable i.e. no earth wire..
Here , double insulated machine only have an active and a neutral pin in the power cable
you can test by testing for continuity between the active and the metal and neutral and the metal
if it has a 3 pin plug consider as not double insulated
